Terms & Conditions

These Terms & Conditions ("Terms") govern your use of JusticeReach (the "Service"), a legal education product operated by The Kusimo-Frazier Law Firm, PLLC("we", "us", "our"), trading as JusticeReach. By creating an account or otherwise using the Service, you agree to these Terms.
1. Who You Are Contracting With
The Service is provided by The Kusimo-Frazier Law Firm, PLLC, a professional limited liability company organized under the laws of West Virginia, USA. You must be at least 18 years old (or the age of majority in your jurisdiction) and have the authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind it.
2. Legal Education, Not Legal Advice
JusticeReach provides general legal information and education about the law of West Virginia. It does not provide legal advice, does not create an attorney-client relationship with The Kusimo-Frazier Law Firm, PLLC, and is not a substitute for consulting a licensed attorney about your specific situation. Outputs from the Service may be inaccurate, incomplete, or out-of-date and should not be relied on for any regulated decision without independent verification by a qualified professional.
3. Generative AI — Acceptable Use
The Service uses generative AI to produce responses. You agree not to use the Service to:
- Generate unlawful, harassing, defamatory, hateful, threatening, fraudulent, or sexually exploitative content;
- Create deepfakes, impersonate real individuals, or generate content designed to mislead courts, government agencies, or other parties;
- Generate malware, instructions for weapons or illegal activity, or content that facilitates violence;
- Attempt to jailbreak, prompt-inject, reverse engineer, or circumvent safety filters or technical limits of the Service;
- Use the Service to file frivolous or vexatious legal documents.
You are solely responsible for the prompts you submit, for how you use any output, for independently verifying accuracy before acting on it, and for ensuring you have the rights to any content you upload. We may remove content, refuse or filter outputs, and suspend accounts that violate these rules.
4. Intellectual Property
The Service, including its software, content, brand, and documentation, is owned by The Kusimo-Frazier Law Firm, PLLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal, non-commercial educational use, subject to your active subscription tier. You may not resell, redistribute, sublicense, scrape, or use the Service to train competing AI systems.
You retain ownership of content you submit ("User Content"). You grant us a limited, worldwide, royalty-free license to host, process, and display User Content solely to operate and improve the Service. If a third-party rights-holder believes content on the Service infringes their rights, they may contact us at bunmi@thekflawfirm.com with a takedown request; repeat infringers will have their accounts terminated.
5. Accounts and Accurate Information
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
6. Payment, Subscriptions, Refunds, and Tax
Subscriptions are sold by The Kusimo-Frazier Law Firm, PLLC and processed by Stripe, our payment processor. Stripe handles card processing and calculates applicable sales tax at checkout. Refunds are handled in accordance with our Refund Policy. Subscriptions renew automatically at the interval you selected at checkout (monthly or annually) until canceled.
7. Service Availability and Warranty Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE". We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any information it produces is accurate. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, goodwill, or legal outcomes. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.
9. Indemnification
You agree to indemnify and hold harmless The Kusimo-Frazier Law Firm, PLLC from any claim arising out of (a) User Content you submit, (b) your unlawful or unauthorized use of the Service, or (c) your breach of these Terms.
10. Suspension and Termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our acceptable use rules. On termination, your right to use the Service ends; you may request an export of your data within 30 days, after which we may delete it.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-laws principles. The state and federal courts located in Kanawha County, West Virginia have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable consumer law grants you the right to bring suit in your home jurisdiction.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and, where appropriate, communicated by email. Continued use of the Service after changes take effect constitutes acceptance.
